Acceptance of Terms The client accepts these general terms and conditions, even if other conditions are stated in their order.
Prices and Quotations • Prices provided in quotations are non-binding unless explicitly indicated as final. • Final prices are valid for a period of 15 days from the date of the quotation. • All prices are exclusive of VAT. Rates communicated for services are determined based on performances.
Delivery and Deadlines • Delivery times are indicative and non-binding unless expressly agreed otherwise. • Deadlines are always formulated in working days. Delays in delivery cannot justify the cancellation of an order or the claim of damages unless explicitly agreed otherwise.
Complaints • Complaints regarding delivery or services must be notified by the customer within 8 working days from the delivery of the goods or the start date of the services, via registered mail. • Complaints cannot be used as a pretext to suspend or delay the payment of invoices.
Invoices and Payment Terms • Invoices are payable within 15 calendar days of the invoice date unless expressly agreed otherwise. • Late payments incur a contractual interest of 1% per month, with each commenced month counting as a full month. • All costs associated with enforcing payment through legal means, including attorney’s fees, will be borne by the customer.
Data Protection • Personal data collected by Dani Hart Coach is processed in accordance with Belgian and EU data protection laws (GDPR). • This data is used to fulfill agreements and may also be used for direct marketing purposes. Clients can opt-out of marketing communications by contacting INFO@DANIHARTCOACH.COM. • Clients may consult, correct, or modify their personal data by sending a signed, dated letter to Dani Hart Coach at the company’s address. • Under no circumstances will personal data be disclosed to third parties.
Changes to Contact Information Clients must timely communicate changes to contact details such as addresses, phone numbers, or email addresses.
Intellectual Property • All intellectual property rights regarding the products and/or services, including designs, software, documentation, and other materials, are owned exclusively by Dani Hart Coach or its suppliers. • The client is granted a non-exclusive, non-transferable right to use the products and results of services for agreed purposes only. • The client may not disclose, reproduce, or share the products or results of services without prior written permission from Dani Hart Coach.
Refund Policy • Non-Refundable Payments: All payments made for coaching sessions, workshops, or trajectories are non-refundable, except as required by Belgian law. • Cooling-Off Period for Distance Sales: If a service is booked online or at a distance, clients have a statutory 14-day cooling-off period, provided the service has not commenced. Once the service begins, clients waive their right to cancellation or refunds for any remaining sessions in the package. • Custom or Personalized Services: Coaching sessions and workshops tailored to the specific needs of the client are exempt from the cooling-off period.
Cancellation Policy • Notice Periods: • Cancellations made 72 hours or more prior to the session will not incur a fee. • Cancellations made between 72 and 24 hours prior to the session will result in a charge of 50% of the session fee. • Cancellations made less than 24 hours before the session will result in the full session fee being charged. • No-Shows: Failure to attend a scheduled session or workshop without notice will result in the full session fee being charged.
Rescheduling Policy • Clients may request to reschedule a session or workshop at least 48 hours in advance of the original date. • Rescheduling requests made within 48 hours of the session may be treated as cancellations and are subject to cancellation fees. • Rescheduled sessions must take place within the same week as the original booking and are subject to the availability of time slots. If no suitable time slot is available, the session will be considered canceled and subject to the cancellation policy. • Sessions rescheduled by Dani Hart Coach will incur no additional cost to the client.
Force Majeure • In the event of extraordinary circumstances beyond the control of either party (e.g., government-imposed restrictions, natural disasters, or emergencies such as a documented medical crisis), sessions, workshops, or keynotes may be rescheduled without penalty. • Force majeure does not include general illness without a medical certificate, scheduling conflicts, or personal inconvenience.
Services and Packages • Current Offerings: • Coaching sessions are available as part of 10-session packages (2 hours each). • Workshops are offered in 5-session blocks (4 hours each). • B2B Keynotes: Tailored for businesses and organizations, these impactful sessions are available upon request. • Future Offerings: • 6-12 month coaching trajectories, including online platforms and group coaching, are currently under development and are anticipated to launch later this year.
Gift Cards • Gift cards are valid only for the duration specified on the card itself. • Gift cards are non-refundable and may not be redeemed for cash. • Gift cards must be used within their validity period unless otherwise agreed in writing.
Governing Law and Disputes • Agreements concluded with Dani Hart Coach are subject to Belgian law. • Any disputes related to the agreements will be exclusively handled by the courts of the judicial district of Antwerp. • Parties agree to attempt alternative dispute resolution (ADR), such as mediation, before pursuing litigation.
